What We Collect

Account Information

When you sign up, we collect your name, email address, company name, and billing information. Payment details are processed by our secure payment partner (Polar) — we do not store full credit card numbers.

Usage Information

We collect IP addresses, browser type, device information, and feature usage patterns to improve our service and maintain security.

Your Email Data

You upload subscriber email addresses and contact data to use Dazzling Mail. You own this data. We process it only to deliver your campaigns, track opens/clicks, and manage unsubscribes on your behalf.

We do not:

  • Sell your data or your subscribers' data
  • Contact your subscribers on our own behalf

Data Sharing

We share data only with essential sub-processors:

Your Rights

  • Correct – Fix inaccurate information
  • Delete – Cancel your account and remove all associated data
  • Opt-out – Unsubscribe from marketing communications

Security

We use TLS 1.3 encryption for data in transit and AES-256 for data at rest. Access is limited to essential personnel only. Backups are encrypted.

Children

Our service is for businesses and individuals over 16 years old. We do not knowingly collect data from children.

Changes to This Policy

We will notify you by email of material changes. Continued use after the effective date constitutes acceptance.

1. Acceptance of Terms

By signing up for Dazzling Mail ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Dazzling Mail is an email marketing and automation platform. We provide tools to create, send, and track email campaigns. We manage the underlying infrastructure (hosting, email sending, database) so you don't have to.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security of your password and for all activities that occur under your account. Notify us immediately of any unauthorized access.

4. Acceptable Use Policy

You may NOT use Dazzling Mail to:

  • Send spam, unsolicited commercial email, or messages that violate CAN-SPAM, GDPR, CASL, or any other anti-spam laws
  • Purchase, scrape, or use email lists without proof of opt-in consent
  • Send content that is illegal, fraudulent, defamatory, harassing, or obscene
  • Send phishing emails or attempt to collect login credentials fraudulently
  • Upload lists containing known children's data without parental consent
  • Use the Service for any illegal activity

You MUST:

  • Include a working unsubscribe link in every marketing email
  • Include your valid physical address in every marketing email
  • Honor opt-out requests immediately (our system does this automatically)
  • Maintain proof of consent for every subscriber (if required by your jurisdiction)

Violation of these terms may result in immediate account suspension or termination without refund.

5. Email Deliverability

While we strive for excellent deliverability, we cannot guarantee that every email will reach the inbox. Delivery depends on many factors including your sender reputation, list quality, and recipient mailbox provider policies.

We reserve the right to pause your sending if we detect:

  • Bounce rates above 5%
  • Complaint rates above 0.1%
  • Suspicious sending patterns

6. Billing & Payments

  • Subscription: Dazzling Mail is a subscription service. You are billed monthly or annually based on your chosen plan.
  • Payment: Payments are processed by Polar. You authorize us to charge your payment method on the renewal date.
  • Cancellation: You may cancel anytime from your dashboard. No further charges will be made. You will not receive a refund for the current billing period, but you retain access until the period ends.
  • Refunds: We do not offer refunds for partial billing periods. If you believe you were charged in error, contact support within 14 days.
  • Fee Changes: We may change pricing with 30 days' notice by email. Continued use after the change constitutes acceptance.

7. Data Ownership

Your Data: You retain all ownership of your email lists, campaigns, and subscriber data. We claim no intellectual property rights over your content.

Our Data: The Dazzling Mail platform, software, branding, and code are our property. You may not copy, modify, or reverse-engineer the Service.

8. Data Portability

Upon cancellation, you may export your lists and campaign data via CSV before your account closes. After the 30-day grace period, data is permanently deleted.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be announced at least 24 hours in advance when possible. We are not liable for downtime caused by third-party providers (AWS, Polar, etc.) or events beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Dazzling Mail is not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of revenue, profits, or data
  • Damages exceeding the amount you paid us in the preceding 12 months

11. Indemnification

You agree to indemnify and hold Dazzling Mail harmless from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or violation of any laws.

12. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time via your dashboard.

Upon termination:

  • Your access to the Service ends
  • Your data will be deleted after 30 days (export it before)
  • You remain responsible for any unpaid charges

13. Governing Law

These terms are governed by the laws of [Your Country/State]. Any disputes shall be resolved in the courts of [Your Jurisdiction].

14. Changes to Terms

We may update these terms with 30 days' notice by email. Continued use constitutes acceptance.

Third-Party Cookies

Email Tracking

When you send email campaigns through Dazzling Mail, we include a tracking pixel (a tiny invisible image) to measure opens and clicks. This is a core feature of the Service and cannot be disabled at the account level, though individual recipients can block images in their email client.

Your Choices

  • Browser settings: Most browsers allow you to block or delete cookies. However, blocking essential cookies will prevent you from logging in.
  • Do Not Track: Our service does not respond to DNT signals because no uniform standard exists.
  • Analytics opt-out: You can install the Google Analytics Opt-out Browser Add-on (if we use Google Analytics).

Overview

Security is critical for an email marketing platform. Your data — and your subscribers' data — must be protected. This document explains how we secure Dazzling Mail.

Employee Access

  • Least privilege: Employees have only the access necessary for their role
  • Background checks: Required for all employees with infrastructure access
  • Audit logging: All access to production systems is logged and reviewed

Payment Security

We do not store credit card numbers. All payment processing is handled by Polar, a PCI-DSS Level 1 certified provider. Your payment details go directly to Polar — we only receive a token representing your payment method.

Incident Response

In the event of a security breach:

  • Detection: Automated systems or manual review identifies the incident
  • Containment: Affected systems are isolated
  • Investigation: Root cause analysis conducted
  • Notification: Affected customers notified within 72 hours
  • Remediation: Patches and fixes deployed

We will notify you by email if your account or data is affected by a breach.

Vulnerability Disclosure

If you discover a security vulnerability in Dazzling Mail:

  • Do not exploit it or disclose it publicly
  • Email security@dazzlingmail.com with details
  • Allow reasonable time (30 days) for us to fix it before disclosure

We do not currently offer bug bounties but will acknowledge responsible disclosures.

Compliance

We follow industry best practices but do not maintain formal compliance certifications (SOC2, ISO 27001) at this stage. If you require certified compliance, contact us to discuss enterprise options.

Third-Party Security

All third-party providers (AWS, Polar) are vetted for security practices and contractually bound to maintain protections equal to or exceeding our own.
